How to Find a Registered Antenuptial Contract (ANC)

An antenuptial contract is registered in the deeds system against the couple who signed it. That means you can find it with a person search — here is how.

An antenuptial contract (ANC) is the agreement a couple signs before marriage to be married out of community of property. Once executed by a notary, it is registered in the Deeds Registry — which means it can be found there against the people named in it.

Where an ANC lives

The ANC is lodged and registered in the deeds system, alongside the property records. Because it's tied to the individuals rather than to a property, the way to find it is a person search: the contract surfaces among the documents registered to that person.

How to find one

  1. Choose the deeds office where the contract would have been registered.
  2. Enter the person's surname, initials or first names, and their ID number (required for POPIA).
  3. Run the free lookup, then open a report. Registered contracts appear in the person's document list.

Getting an actual copy

Each document in the report — including a registered ANC or a marriage contract — has an Order Copy option. We obtain the official copy from the registry on your behalf. Anything you've already paid toward the report is credited toward the copy.

Married out of community of property?

An ANC is what makes a marriage "out of community of property" (often with or without accrual). If you're trying to confirm a couple's marital property regime, a registered ANC in the deeds record is the documentary evidence — see our guide on checking in or out of community of property.
